Dog Bite Cases in Colorado

Knowing who is Responsible and Recovering Damages

The number of dog bite accidents in the United States is disturbing. Each year more than 4 million innocent children and adults are seriously injured or killed as a result of a dog bite injury.

Colorado Dog Bite Law

In 2005 Colorado passed a law that makes a dog’s owner liable for dog bites if the dog bite victim is bitten while lawfully on public or private land. Even if the dog does not have a history of viciousness, and even if the owner did not know the dog was or could be dangerous, the dog owner is responsible for injuries or death caused by the dog.

If you are the victim of a dog bite in Colorado, you are entitled to recover your economic damages. This can be accomplished through working with insurance companies or by filing a civil lawsuit against the dog’s owner. 

Dog bite victims are not entitled to collect money for pain, suffering, and inconvenience.  If you were bitten by a dog, but were trespassing (or on a property posted “No Trespassing” or without permission), the dog’s owner will not be liable for any of your injuries. The law states that a “Beware of Dog” sign is warning enough to keep a dog owner from being liable for your injuries if you are on their private property.

What to Consider if you are the Victim of a Dog Bite in Denver or Colorado Springs:

- If you are the victim of a dog bite, first you need to determine if you need medical attention. Your first concern should be for your health and safety. If you believe you are injured, call 911 immediately!

- Ask the owner for their contact information and copies of papers verifying the dog has had the appropriate shots.

- If the dog’s owner is not around or leaves the scene of the dog bite, look around for witnesses. See if there is anybody on the scene who saw the dog bite and can make a statement to the police about the circumstances.

- Call the police and report the dog bite and request they come to the scene and make a thorough dog bite police report.

- Take pictures of your dog bite injuries.

- Request a copy of all of your current insurance policies.

- Seek out the council of an experienced dog bite attorney. You may be able to not only recover damages from the person whose dog bit you, but also from your own insurance company.
